Court order for instutution
« on: November 24, 2011, 03:17:00 PM »
How do I get a court order to put my wife in a institution for her own safety. She has a degree in psychology and I don't. She has a physical disease called Lymphedema? and a serious heel wound with extreme pain. She needs to be in the hospital for control of the disease and the heel pain but absolutely refuses to go. If she falls for any reason he the situation will worsen. She will not go into a hospital for treatment or see a mental health tech...for no reason.
Can anything be done to help her against her will she will not help herself. pljames

Depending on what country you live in the law varies widely. In the US it takes alot to force treatment on someone. Unless they are a minor, or have been previously diagnosed with a mental illness. Unless it can be shown for certain that the condition is life treatening it is the persons right to refuse treatment. Even then it can still be hard to force treatment. As far as having someone commited to a mental facility because they refuse treatment I don't think that is possible. Refusing treatment is a choice that is the right of the patient. Even though it may seem to be irrational to you it is still her right.
My wife had Lymphodemia. In her case it was an inconveniece and was not life treatening. It can become life threatening in extreme cases. If you attempt to force treatment for the foot injury you could make the situation worse. Possibly she would take it as an attempt to control her and become even more determined. In most cases I have seen the pain will eventually become sever enough that the person will say okay I need help.
My suggestion would be to try and rationally talk to her and discuss her options. If she has friends or relatives that she trusts? Think about getting them involved. Good Luck!

Is that what you really think?
