Death Penalty

The death penalty is a debate in its own in America, but out of that debate also comes whether someone who has been declared mentally unfit by the state should be held to equal standards and also be eligible to receive the death penalty.

One way to look at it is the 14th amendment which states all persons are equal under the law, and therefore we should treat them all the same.

The other side points out that the person may have not wished to commit the crime, but they were unaware due to their condition.

What do you all think?

a tough subject but if a person kills someone then whether they meant to or not shouldnt be a factor init. imo they should be given the death penalty.

Hmm I think the death penalty is a bit...hmmm...
For instance, if you are killing someone that killed a lot of people to show that killing is bad...it's all a bit hyprocritical in my opinion.

But the thing is, you are not killing someone to show that killing is bad. You are killing someone as a punishment to say, you broke one of the worse laws on the book, you not only violated someone's rights, but you also took someone's life. Its not meant to say this is wrong, it is meant to punish.

However, with the main topic. I see the execution of mentally "insane" persons for punishment of crimes that deems death as a possibility as alright. To me it is a legal thing, the 14th amendment basically states all citizens are equal under the law. Favoring someone because they are "mentally ill" is unconstitutional.

Sorry guys but, probably today i m in a sort of no-no mood for your views. Death penalty should be given to criminals or people, who are faking being mentally unfit.

However, giving death punishment to a mentally unfit person is not the way to go. How could anyone even think about it. They are in general not in there senses. When you talk about equal rights, just look at it that how much rights that these mentally retarded people receive. you have already thrown them off your society and let them live alone in their own society, of which they are the only members.

Guys talk about equal rights, No probs. however, don bring in those people, who were never a part of such equal rights for a long time.

Anyways, I am strictly against the death punishment, even if the whole crew goes against me.

I don know about giving them death penalties...Yet I will say that they should be shown the right method for surviving in life....

Death penalties are given to criminals for committing some grave crime so that no other person would not have the courage to repeat the same crime again since they know it would lead them to death. If the crime in concern is a one which cannot be forgiven, like murder then death punishment is justified for that crime. If however the person committing the crime is one who is mentally unfit there is no point in handing a death penalty to them as they have committed the crime without even realizing what they have done.

I have nothing against giving them the death penalty. Some mentally "unfit" individuals do not go around killing, so what causes others to do so? I still see them as having free will in many aspects. Behaviorally they still know that killing someone is wrong. I have been in classes of mentally handicapped students and even they understand this. So if they commit the crime, let the punishment meet the crime.

Mentall illness is not a good reason a murderer cannot be sentenced for what they have done. It is just unfair for the vicitm. But somehow, there must be a reason why they committed a murder.

Could the reason be they just did not like the person or they just lost their logic skills for a moment?  You are correct though, mental "insanity" is not a legitimate excuse for such people to get away with murder. Punishment is needed.

the death penalty is necessary because it shows the individuals that commit these heinous crime that there is punishment for there actions and those who are mentally "insane" should not get out of this punishment everyone is accountable for there own actions

The death penalty is necesary to a good society, A murderer kills someone, that person dies, because the one who got killed was most likely innocent, and therefore had no reason to die.
